Terms of Service

1. About these terms

These Terms of Service ("Terms") govern your use of MyBoilerPal ("Service"), operated by ApeTec Ltd ("we", "us", "our"), a company registered in England and Wales (Company Number 17065917). By using the Service you agree to these Terms.

2. The service

MyBoilerPal provides automated missed-call recovery for UK boiler installation businesses, including SMS-based lead qualification and AI voice callback functionality. The Service integrates with the Twilio platform for telephony and the OpenAI platform for voice AI.

3. Subscriptions and billing

Subscriptions are billed monthly in advance via Stripe. Plans available at the time of writing are Solo (£199/mo) and Team (£299/mo). You may cancel at any time; your subscription will continue until the end of the current billing period. No refunds are provided for partial months.

4. Acceptable use

You agree not to:

  • Use the Service for unlawful purposes
  • Send unsolicited marketing messages to consumers in violation of UK PECR or GDPR
  • Attempt to circumvent rate limits, security controls, or usage caps
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use the Service to harass, defame, or harm others

5. Your data

You are responsible for ensuring you have lawful basis to process the personal data of the leads you handle through the Service (typically legitimate interest or consent under UK GDPR). You confirm you have a privacy policy disclosing your use of automated communications. We process data on your behalf as a Data Processor; see our Privacy Policy for details.

6. Compliance

You agree to honour all opt-out requests (replies of "STOP", "UNSUBSCRIBE", or similar) immediately. The Service automatically processes these on your behalf, but you remain the Data Controller for your leads.

7. Service availability

We aim to provide the Service with reasonable uptime but make no guarantees. The Service may be unavailable during maintenance, third-party outages (Twilio, OpenAI, Supabase, Vercel), or for reasons outside our control.

8. Limitation of liability

To the maximum extent permitted by law, our total liability to you for any claim arising from the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or business losses.

9. Termination

We may suspend or terminate your account for breach of these Terms, non-payment, or if the Service is discontinued. You may terminate by cancelling your subscription.

10. Governing law

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
